Continuous Power of Attorney: A Safety Net for the Unexpected

Life is full of surprises, and not all of them are pleasant. Whether due to age, illness, or unforeseen circumstances, there may come a time when you're unable to manage your own affairs. For English-speaking immigrants in Israel, this prospect can be especially daunting. Fortunately, a continuous power of attorney (CPA) offers a proactive solution.

A CPA allows you to appoint a trusted individual to handle your personal, medical, and financial matters if you become incapacitated. Unlike a general power of attorney, which expires if you lose mental capacity, a CPA remains valid and ensures that your affairs are managed according to your wishes.

This legal tool is particularly valuable for olim (immigrants) who may not have close family nearby. Appointing a representative who understands your preferences and values gives you peace of mind and spares your loved ones the burden of making difficult decisions during a crisis.

While the CPA is often associated with the elderly, it's equally important for younger individuals, especially in Israel. Our country frequently faces unique challenges, including periods of war, terror attacks, and the mobilization of reserve soldiers. These unpredictable events can leave even younger people temporarily or permanently unable to manage their affairs. A CPA ensures that your interests are protected in such scenarios, and your responsibilities are entrusted to someone you trust.

From my experience, clients who were initially skeptical about this mechanism were quite satisfied once they saw the final document and the tailored options it includes. These options cover a range of financial and health-related decisions, providing peace of mind and a sense of control over their future, even in uncertain circumstances.

In Israel, the CPA must be prepared and certified by a lawyer who has completed specialized training. The lawyer can guide you through the process, ensuring that your CPA reflects your unique needs. He/she will discuss with you the scenarios you want covered, from medical treatment preferences to financial arrangements, and formalize these decisions into a legally binding document.
